Highly Experienced Criminal Defense Lawyer Zealously Defending the Rights and Freedom of Clients Throughout San Diego

If you’ve been charged with a crime in San Diego, few things in your life are more important than resolving your case in a way that impacts your life as little as possible. However, San Diego prosecutors aggressively pursue convictions, and, given their track record, it’s essential that you have an experienced San Diego criminal defense attorney of your own. At the Law Office of Joshua R. Bourne, we proudly defend clients throughout San Diego County who have been charged with all types of crimes. Attorney Josh Bourne understands that the prosecution’s case against you doesn’t provide the full story and certainly doesn’t define who you are. With our help, you can effectively defend against the government’s allegations in hopes of securing an outcome that you can not only live with but are happy with.

Types of Cases We Handle

At the Law Office of Joshua R. Bourne, we have developed a reputation as a renowned San Diego DUI defense and domestic violence defense firm. However, we also handle a wide range of other serious criminal cases on behalf of our clients, including:

  • Assault offenses,
  • Burglaries,
  • Drug crimes,
  • Federal Crimes,
  • Gang crimes,
  • Sex offenses,
  • Theft charges,
  • Vehicular homicide cases, and
  • White-collar crimes.

Regardless of the nature of the allegations against you, it doesn’t change the fact that you are innocent until proven guilty. It’s the government’s job to prove every element of the offense against you—if it can. And that’s where criminal defense Attorney Josh Bourne comes in. We can help you identify the defenses that may apply to your case, and we will work with you to develop a comprehensive strategy designed to minimize your exposure and, ultimately, prevent the prosecution from securing a conviction.

About Joshua Bourne

Joshua R. Bourne is a dedicated San Diego criminal defense attorney who has more than two decades of experience advocating on behalf of the criminally accused. After graduating from law school, Mr. Bourne worked as a Deputy City Attorney in San Diego, prosecuting cases that arose within San Diego proper on behalf of the government. While here, Mr. Bourne spent much of his time in the Domestic Violence Unit, where he gained valuable insight into how DV crimes are prosecuted and what causes a prosecutor to doubt the strength of their case.

After leaving the City Attorney’s office, Mr. Bourne spent a short time with a large civil law firm, where he honed his negotiation and litigation skills. Once Mr. Bourne was confident he had acquired the understanding and skills needed to open up his own firm, he established the Law Office of Joshua R. Bourne.

Since the firm’s founding in 2006, the Law Office of Joshua R. Bourne has earned a reputation in the San Diego legal community for defending complex DUI cases as well as those involving high-stakes allegations of domestic violence, including many cases that alleged enhancements under the California Three Strikes Law.

In addition to handling cases on behalf of the firm, Mr. Bourne also successfully obtained a special certification from San Diego County, allowing the court to appoint him as conflict counsel for indigent defendants who could not afford an attorney. Mr. Bourne also acquired the necessary certification from San Diego County to handle juvenile delinquent and dependency matters.

Frequently Asked Questions

What Is the California Three Strikes Law?

Enacted in 1994, the California Three Strikes Law is a criminal justice policy that was intended to reduce violent crime by imposing incredibly strict penalties on repeat offenders. Under the Three Strikes Law, any person with two prior convictions for serious or violent felonies would, upon committing a third felony, face a mandatory life sentence with the possibility of parole only after 25 years.

While many provisions of the Three Strikes Law have been stepped back in recent years, the framework is still in existence. As a result, those facing “serious” or “violent” felonies must consider not only the immediate impact of a conviction but also the effect that accruing a strike will have on their future.

What Crimes Count as “Strikes” in California?

Under California Penal Code 667, a strike is any conviction for a “serious” or “violent” felony. Examples of what constitutes a strike include the following:

  • Residential burglary,
  • Arson,
  • Federal crimes,
  • Robbery,
  • Kidnapping,
  • Murder,
  • Crimes involving explosive devices
  • Many sex offenses,
  • Any offense in which the defendant personally used a weapon, and
  • Any offense in which great bodily injury was inflicted.

For a complete list of serious and violent felonies, consult Penal Code § 667.5(c) and § 1192.7(c).
